Riprap Program Application and Indemnity Release

Guidelines

  • The City of Peachtree Corners will provide a single dump truck load (+/- 18 tons) of riprap to eligible property owners per their request, a maximum of once every 2 years.  Only full loads will be delivered.
  • Property owners must fill out an application, sign a release and indemnity form, and submit a $200 deposit.  
  • The $200 deposit is required to be submitted once the application is reviewed and approved and will be returned within 90 days if all guidelines of this process are met by the applicant.
  • The applicant’s deposit will not be returned if the riprap is not moved out of the right of way and installed within 30 days of receiving delivery.  After 30 days, the property may be subject to Code Enforcement Action.
  • This program will be available beginning January 1 of each calendar year on a first come, first served basis until the annual funding allocation for this program has been exhausted.  At that point, a wait list will be developed for the following year.  
  • The riprap will be delivered in front of the home requesting rock, in a designated location within the right of way.  The rock will not be placed on a city street.  The property owner must mark the desired location of the riprap delivery with a flag, colored paint on the ground, or otherwise clearly designated for the contractor making the delivery.  The rock will be delivered directly from the quarry so the city cannot guarantee an exact day or time but will coordinate with the owner to the extent possible.
  • Rock provided by the city is to be solely used to stabilize stormwater channels, eroded areas impacted by stormwater runoff, and drainage easements.  Rock cannot be used for any other purposes such as landscaping, retaining walls, decoration, etc.
  • Each application will be reviewed by a staff member for verification of eligibility, area to be installed, and location of delivery.  
  • The city will not assist the property owner move or install riprap.  The city reserves the right to inspect all completed work.
  • Property Owners are responsible to remove any excess riprap or debris from the delivery from their property.  The city will not return to remove unused riprap or debris.
  • City of Peachtree Corners makes no assurances to the effectiveness of using riprap as an erosion control measure.
  • The city is not responsible for any damage resulting from providing these services.
  • Applicants who provide their signature below affirm that they know or have received professional guidance on how to place and mitigate issues associated with the use of riprap.

The undersigned property owner requests that the City of Peachtree Corners Public Works Department arrange for a delivery of riprap to their property for use in addressing drainage/erosion problems.  The intent of this program is to help reduce erosion caused by surface drainage, and not for landscaping, aesthetic, or building purposes.  If materials are not installed per this agreement within 30 days of delivery, the undersigned understands that their deposit of $200 will be forfeited.

The city will provide for a single dump truck load (+/- 18 tons) of riprap.  Most stone will measure approximately 6 to 18 inches in length and width but may contain smaller or larger stone.  Only full loads will be delivered.

The property owner requests that the city have the riprap delivered in the right of way at a location designated by the owner.

In consideration for the city providing riprap to the property owner, the undersigned owner releases and agrees to indemnify the City of Peachtree Corners and its agents and employees from any and all claims of any kind arising from the services requested herein.  This release and indemnity includes, without limitation, damage to driveways, curbs, sidewalks, plants, and landscape. 

Furthermore, the property owner agrees to be responsible for removing any and all excess and unused rip rap and debris from the right of way within 30 days.  In the event this not accomplished, the $200 deposit will be forfeited, and the property may be subject to Code Enforcement Action.
